Affiliate Terms of Use

Affiliate Program

The affiliate program allows ICDSoft's affiliates to make profit by referring customers to ICDSoft through a link or a banner on their websites. Referrals will be counted whenever the customer completes a purchase of a web hosting account with us. The following services offered by ICDSoft are not a subject of the affiliate program: domain names, SSL certificates, additional resources (dedicated IP addresses, traffic, slots for parked domains, databases, etc.).

The affiliate can create promo codes that share the discount between the affiliate and the customer.

ICDSoft will review all affiliate signups before approving them. A signup might be rejected if ICDSoft determines that it is not suitable for our affiliate program.

Affiliate Obligations and Restrictions

The affiliate must keep the contact details of the affiliate account up to date, including the contact name, email address, and phone number.

The affiliate is responsible for providing correct payout details and making sure he/she is able to accept payments from ICDSoft.

The affiliate agrees that he/she will comply with all local, state, and federal laws concerning the sending of emails. ICDSoft has a very strict anti-spam policy, and sending unsolicited mails will not be tolerated. Affiliates that have been sending unsolicited mail in order to increase the number of leads to ICDSoft's website will be subject to immediate account termination without payment of the accumulated funds.

The affiliate must disclose the affiliate relationship with ICDSoft on their website.

The affiliate is not allowed to use masking or cloaking to hide the affiliate links to our website.

The affiliate is not allowed to use domain forwarding to our website with an affiliate link.

The affiliate is not allowed to use techniques that set the tracking cookie without the user actually clicking on the referral link, such as a 1x1 pixel iframe.

The affiliate is responsible for making sure that their links are working correctly after making any changes to them. Referral fees may not be paid for tracking errors caused by editing, masking, redirecting, or tampering with affiliate links, as determined at the sole discretion of ICDSoft.

The affiliate may not claim that ICDSoft provides services or resources not listed on ICDSoft's website.

The affiliate agrees that the website used for the affiliate program and linking to ICDSoft's website does not and will not contain violent, discriminatory, illegal, or "adult only" content, material infringing trademarks of a third party, or material that is threatening or obscene.

The affiliate acknowledges that "ICDSOFT" is a registered trademark, and as such, it is not allowed to be used for bidding on PPC (pay-per-click) networks and search engines. The following keywords are not allowed for bidding: "icdsoft", "icd soft", "icdsoft.com", "www.icdsoft.com".

Tracking

ICDSoft may elect to use any methods available, which at any particular time may be deemed by ICDSoft to be the most accurate, to track the links from the Affiliate's website to ICDSoft's website and the final purchases. This includes but is not limited to the use of cookies.

Sales through affiliate links are tracked with persistent cookies. The cookie lifetime is 30 days, and for the purchase to be counted, the customer must complete the order process within that period after clicking the link.

Sales through promo codes are tracked with session cookies.

Promo codes take precedence over affiliate links.

If multiple Affiliates refer the same customer, only the last referrer will receive commission for the referral.

Affiliate referrals that are not automatically tracked must be reported by the Affiliate to ICDSoft within 30 days. They will be accounted at our sole discretion, provided that the purchase meets the rest of these terms, the customer does not object, and ICDSoft does not have other information that the claim is false.

Referral Fees

The affiliate receives a referral fee, calculated as a percentage of the base price.

For hosting accounts with annual billing, the referral fee is 75% for the first billing period of hosting, and 10% for each recurring renewal up to the third billing period for that account.

For hosting accounts with monthly billing, the referral fee is 75% for the first billing period of hosting, and 10% for each recurring renewal up to the twelfth billing period for that account.

The referral fees are added to the affiliate's balance on the day of the purchase for the first billing period, and one day after each next billing period has started.

The referral fees are applicable only for new customers brought to our service through the affiliate link. The new customers must purchase the account through ICDSoft's main order page.

The referral fees are not applicable for orders of existing clients who have logged in to ICDSoft’s site.

In the event of possible credit card fraud or high cancellation rates, ICDSoft reserves the right to hold commissions for up to 100 days.

ICDSoft reserves the right to deduct referral commissions paid out for fraudulent or refunded sales from the affiliate’s current and future commissions.

The referral fees are paid out on a weekly basis using PayPal or bank transfers.

The referral fees can be paid out using a bank transfer only if the affiliate has accumulated over $100 USD in their affiliate balance. There are no such restrictions for PayPal payouts.

The transaction fees for paying out the referral commission using a bank transfer are covered by the affiliate if the payout is less than $200 USD.

The referral fees offered by ICDSoft may change at any time without prior notice.

Abuse

Any attempt of the following is grounds for immediate termination without payment of the accumulated funds. In addition, any such attempts will be prosecuted to the fullest extent of the law:

Undermine, slander, libel, threaten or cause harm to ICDSoft's customers, employees and property, or to the company directly.

Cheat ICDSoft's tracking system, or purposefully bring visits that result in fraudulent purchases.

Misinterpret or improperly use ICDSoft’s intellectual property, or impersonate ICDSoft’s personnel.

indemnification

The customer agrees to indemnify, defend and hold harmless, ICDSoft, its subsidiaries, and other affiliated companies, its officers, directors, employees, and agents from and against all losses, expenses, damages, and costs, including reasonable attorneys' fees, resulting from any violation of these Terms of Use.

Privacy Policy

ICDSoft respects the right to privacy of customers and visitors of this site and is committed to protecting it. We will collect personal information about our affiliates during the registration process, which may include but is not limited to: affiliate's full name, postal address, phone and fax number, email address. This type of information allows us to keep in touch with the affiliates regarding commission payouts and any other services performed by ICDSoft or by the affiliate. This information may also be used to notify the affiliate about service maintenance or upgrades, but will not be shared or sold to third parties for any purpose. ICDSoft maintains a strict privacy policy, which means that we do not intend to sell, rent, or otherwise give your information to third parties.

Disclaimer

ICDSoft, at its sole discretion, may change these terms and conditions at any time. By using ICDSoft's services the customer agrees that ICDSoft may: (1) revise these terms and conditions; and (2) change the services provided. Any such revision or change will be binding and effective immediately on posting of the revised terms or change to the service(s) on ICDSoft's website, or on notification to the customer by email. The customer agrees to review ICDSoft's website, including these terms, periodically to be aware of any such revisions. If the customer does not agree with any revision, he/she may terminate the services at any time by notifying ICDSoft by email or via the support website (https://www.suresupport.com). Notice of the customer's termination will be effective on receipt and processing by ICDSoft. The customer agrees that, by continuing to use ICDSoft's services following notice of any revision to this Agreement or change in service(s), he/she abides by any such revisions or changes.

The content available through this site is the sole property of ICDSoft and is protected by patent, copyright, trademark, and other intellectual property laws. Except as otherwise explicitly agreed in writing, ICDSoft-owned content received through this website may be downloaded, displayed, reformatted, and printed for your personal, non-commercial use only. The customer agrees not to reproduce, retransmit, distribute, disseminate, sell, publish, broadcast, or circulate the content received through this website to anyone, including but not limited to others in the same company or organization without ICDSoft's express prior written consent.

ICDSoft reserves the right at its sole discretion to refuse or cancel a service. Violation of any of ICDSoft's Terms could result in a warning, suspension, or account termination. Submitting fake personal information can also be grounds for suspension or termination.

Limited Liability

THE CUSTOMER AGREES THAT ICDSOFT SHALL NOT BE LIABLE FOR ANY (1) SUSPENSION OR LOSS OF THE SERVICE(S), (2) USE OF THE SERVICE(S), (3) INTERRUPTION OF ICDSOFT'S SERVICES OR INTERRUPTION OF THE CUSTOMER'S BUSINESS, (4) ACCESS DELAYS OR ACCESS INTERRUPTIONS TO ICDSOFT'S WEBSITE(S) OR SERVICE(S) OR DELAYS OR ACCESS INTERRUPTIONS THE CUSTOMER EXPERIENCES IN RELATION TO THE SERVICES OFFERED BY ICDSOFT; (5) LOSS OR LIABILITY RESULTING FROM ACTS OF OR EVENTS BEYOND ICDSOFT'S CONTROL (6) DATA NON-DELIVERY, MIS-DELIVERY, CORRUPTION, DESTRUCTION OR OTHER MODIFICATION; (7) LOSS OR LIABILITY RESULTING FROM THE UNAUTHORIZED USE OR MISUSE OF THE CUSTOMER'S ACCOUNT. ICDSOFT ALSO WILL NOT BE LIABLE FOR ANY INDIRECT, SPECIAL, INCIDENTAL, OR CONSEQUENTIAL DAMAGES OF ANY KIND (INCLUDING LOST PROFITS) REGARDLESS OF THE FORM OF ACTION WHETHER IN CONTRACT, TORT (INCLUDING NEGLIGENCE), OR OTHERWISE, EVEN IF ICDSOFT HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN NO EVENT SHALL ICDSOFT'S MAXIMUM AGGREGATE LIABILITY EXCEED THE TOTAL AMOUNT PAID BY THE AFFILIATE FOR THE DISPUTED SERVICE, BUT IN NO EVENT GREATER THAN ONE HUNDRED DOLLARS ($100.00). BECAUSE SOME STATES DO NOT ALLOW THE EXCLUSION OR LIMITATION OF LIABILITY FOR CONSEQUENTIAL OR INCIDENTAL DAMAGES, IN SUCH STATES, ICDSOFT'S LIABILITY SHALL BE LIMITED TO THE MAXIMUM EXTENT PERMITTED BY LAW.
